These Terms of Service govern your use of the GreatPoint website (https://greatpoint.co) and any software development services provided by GreatPoint. "GreatPoint", "we", "us", and "our" refer to the software company operating under that name from Lahore, Pakistan. By engaging our services or using our website, you agree to these terms.
GreatPoint provides custom software development services including, but not limited to: web application development, mobile app development, AI integration, process automation, cloud infrastructure, ERP implementation, and Microsoft Business Central consultancy.
Each client engagement is governed by a separate Statement of Work (SOW) or project agreement that defines the specific scope, deliverables, timeline, and pricing. These Terms of Service apply to all engagements in addition to any project-specific agreement.
Work begins only after a written agreement (SOW, proposal, or contract) has been signed by both parties. Changes to project scope must be agreed in writing. We use a change request process to document scope additions and their impact on timeline and cost. We will never add work to a project without your explicit approval first.
Payment schedules are defined in individual project agreements. Our standard terms are: 30% deposit before work begins, 40% at a defined project midpoint, and 30% upon final delivery and acceptance. For retainer or time-and-materials engagements, invoices are issued monthly.
Invoices are payable within 14 days of issue. Late payments accrue interest at 2% per month on the outstanding balance. We reserve the right to pause work on accounts more than 30 days overdue.
Upon receipt of full payment for a project, you own all custom code, designs, and deliverables created specifically for your project. GreatPoint retains ownership of any pre-existing proprietary frameworks, libraries, utilities, or tooling used in the development process — however, you are granted a perpetual, royalty-free licence to use these as part of the delivered product.
Open-source components used in your project are subject to their respective licences, which we will document in our deliverables.
Both parties agree to treat as confidential any proprietary, business, or technical information shared during the engagement. GreatPoint will not disclose your project details, business processes, or data to third parties without your consent. We are happy to sign a mutual NDA before discovery calls if required.
GreatPoint warrants that all delivered software will perform substantially as described in the agreed specifications at the time of delivery. We provide 30 days of free post-launch support to fix bugs and defects in the delivered work. After this period, ongoing support is available under a separate maintenance retainer agreement.
We do not warrant that software will be error-free under all circumstances, or that it will be compatible with third-party services that change their APIs or terms after delivery.
GreatPoint's total liability for any project or engagement shall not exceed the total fees paid by the client for that specific project. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or business interruption, even if we have been advised of the possibility of such damages.
Successful projects require collaboration. You agree to: provide timely feedback and approvals at agreed checkpoints; supply accurate content, data, and access credentials when requested; designate a primary point of contact with authority to make decisions; and communicate changes in requirements promptly rather than at the end of a phase.
Delays caused by late client feedback or approvals may extend project timelines and, in some cases, incur additional costs.
Either party may terminate an engagement with 14 days written notice. Upon termination, you are responsible for payment of all work completed up to the termination date. GreatPoint will deliver all completed work and assets in an orderly manner. Deposits are non-refundable once development has commenced.
These terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes that cannot be resolved through good-faith negotiation shall be submitted to arbitration in Lahore, Pakistan, under applicable Pakistani arbitration rules.
We may update these terms from time to time. The current version is always available at https://greatpoint.co/terms/. Continued use of our services after an update constitutes acceptance of the new terms.
